Terms & Conditions


Please make sure you read our Handy Tips page before requesting a quote. It is your/the client's responsibility to ensure the details to be quoted are accurate. You the client, agree that by accepting the quote via payment of a 50% deposit, you also agree to the following terms and conditions:

PAYMENT

A 50% deposit is required (by all parties IF multiple clients involved) for Kyneton Fencing to schedule works, with the complete balance due within 7 days of the completion of quoted works. Payment is acceptable by cash or EFT to: Kyneton Fencing, ANZ, BSB: 013706, Account No: 2616-66505.

QUOTES
All Kyneton Fencing quotes are an estimate and may be subject to change under certain circumstances.
Kyneton Fencing will discuss any changes in costs estimates prior to work commencing, if/where possible. Quotes are valid for 30 days from date of issue. All prices quoted include GST. Commencement and completion date estimates may be adjusted and/or extended by Kyneton Fencing at their discretion including but not limited to when circumstances are beyond Kyneton Fencing’s control.

MATERIALS
All materials used in the quoted works remain the property of Kyneton Fencing until full and final payment is made by all parties involved. Any debt collector fees incurred will be the sole responsibility of you, the client/debtor.

SITE CONDITIONS

It is the client’s responsibility to make all necessary inquiries and to assume all costs associated with engaging the relevant authorities and service providers to locate the exact position of all underground services including, but not limited to, gas, electricity, water, phone, drainage and sewerage. It is the client’s responsibility to ensure all underground services are accurately located and marked prior to commencement of works by Kyneton Fencing. In the event that a client gives Kyneton Fencing approval to commence works without having had services professionally located and marked, then all care, but no responsibility, is accepted by Kyneton Fencing for any damage to underground services that might occur during works. Upon payment of the 50% deposit, the client agrees to indemnify Kyneton Fencing of all third-party liabilities, including but not limited to, any resulting from damage to underground services.

The client is responsible, if/when necessary, for fees associated with organising to have the common boundary/s surveyed and for ensuring the surveyor’s pegs are visible/locatable, prior to Kyneton Fencing commencing works. In the event the client elects not to engage a surveyor to locate the common boundary, the client agrees on acceptance of the quote for the new fence to be constructed on the same line as the existing fence. Kyneton Fencing accepts no responsibility for the location accuracy of an existing fence on the common boundary. Please refer to the Fences Amendment Act 2014 for your responsibilities and such as in the event of a boundary dispute with your neighbour/s.

Extra costs may be incurred by the client should any hidden obstacles be struck when digging holes (such as, but not limited to, large rocks, tree roots, broken posts, old concrete) or if other such unexpected adverse site conditions are encountered. These costs may include hiring extra equipment and the ruling hour-rate for extra labour. Kyneton Fencing will endeavor to discuss any such issues at the first opportunity during the works.

Please provide adequate water and power on site or make alternative arrangements (e.g. from a neighbour or equipment hire service). The client agrees to indemnify Kyneton Fencing of all public liability regards any accident and/or injuries that may occur on the work site. The client is responsible for the safety and restraint of any adults, children and pets for the duration of the works. The work site requires strict adherence to workplace health & safety policies at all times.
